Drawing on a close reading of Pierre Bourdieu’s works, I offer five lessons for a science of crime and punishment: always historicize; dissect symbolic categories; produce embodied accounts; avoid state thought; and embrace commitment. I offer illustrative examples and demonstrate the practical implications of Bourdieu’s ideas, and I apply the lessons to a critique of orthodox criminology.

In his late lectures, Foucault developed the ancient Greek concept of parrhesia, a courage to speak the truth in the face of danger. While not entirely uncritical of the notion, Foucault seemed to find something of an ideal in the political and aesthetic ideal of franc-parler, of speaking freely and courageously. Simultaneously, the post-1968 political valorized the ideal of parrhesia, or “speaking truth to power”: parrhesia seemed inherently progressive, the sole preserve of the left. But a cursory inspection of the (...) annals of Nazism and fascism shows that these movements also aligned themselves with parrhesiastical modes of expression. The fragmented, disparate strands of today’s neo-fascist revival, too, are closely imbricated with the notion of speaking valiantly in the face of supposed orthodoxies: in many ways, the preeminent parrhesiasts today are found on the neo-fascist side. This points to an essential weakness in the concept of parrhesia, particularly in terms of its value and valence as a strategy for the political left. Perhaps it matters less how we speak—being caught up in language games—than what policies and programs we enact. Žižek’s plea for a renewed dogmatic orthodoxy and Chesterton’s criticism of heresy offer ways out of the parrhesiastical trap. (shrink)

J. L. Mackie famously argued that a commitment to non-existent objective values permeates ordinary moral thought and discourse. According to a standard interpretation, Mackie construed this commitment as a universal and indeed essential feature of moral judgments. In this paper I argue that we should rather ascribe to Mackie a form of semantic pluralism, according to which not all moral judgments involve the commitment to objective values. This interpretation not only makes better sense of what Mackie actually says, but also (...) renders his error theory immune to a powerful objection. (shrink)

Non-naturalists about normativity hold that there are instantiable normative properties which are metaphysically discontinuous with natural properties. One of the central challenges to non-naturalism is how to reconcile this discontinuity with the supervenience of the normative on the natural. Drawing on J. L. Mackie’s seminal but highly compressed discussion in Ethics: Inventing Right and Wrong, this paper argues that the supervenience challenge as usually conceived is merely a symptom of a more fundamental challenge in the vicinity.

Ce mémoire vise à élucider le rapport entre la violence et le pouvoir souverain à partir de la Critique de la violence de Walter Benjamin et Force de loi de Jacques Derrida. Les réflexions proposées ici sont issues de deux constats : (i) que nos structures politiques reposent sur l’emploi continu de la violence et (ii) qu’une révolution abolit l’ordre existant en s’accordant le monopole sur la violence légitime, reconduisant ainsi le cycle de la violence. Cet article cherche à approfondir la conclusion de Hume selon laquelle l’induction, malgré son importance comme méthode inférentielle, est injustifiable. J’argumente en particulier que l’induction devrait être comprise comme un processus psychologique fondamental. Mon plan est le suivant : après un résumé du problème de l’induction humien, j’offre une rapide argumentation en faveur de la conceptualisation de l’induction comme une inférence à la meilleure explication (IME). Ensuite, je propose un argument original visant à montrer que l’IME est un processus psychologique (...) fondamental. Cet argument s’appuie sur une analyse du concept d’explication prouvant qu’une explication nécessite toujours l’existence d’un agent épistémique. J’utilise ce résultat afin de montrer que l’IME est un processus psychologique fondamental. Or, les institutions publiques savent que leurs recommandations seront souvent ignorées en partie par le décideur. In The Birthright Lottery, Ayelet Shachar subjects the institution of birthright citizenship to close scrutiny by applying to citizenship the historical and philosophical critique of hereditary ownership built up over four centuries of liberal and democratic theory, and proposing compelling alternatives drawn from the theory of private law to the usual modes of conveyance of membership. Nonetheless, there are some difficulties with this critique. First, the analogy between entailed property and birthright citizenship is not as illustrative as Shachar intends it (...) to be; second, the mechanism of the birthright privilege levy is insufficient for addressing structural impediments to growth; and third, the principle of ius nexi, while an important corrective to currently dominant principles of nationality, will likely have effects both unnecessary and insufficient to correct the injustices that Shachar identifies. In the end, the most significant improvements in the lives of the neediest persons on the planet are more likely advanced through conventional arguments for the lowering of barriers to the circulation of goods, labor, and capital. Dans cet article, je propose de défendre le monisme russellien, une théorie posant l’existence de quiddités phénoménologiques au fondement de la réalité. Je propose en particulier de montrer que le monisme russellien échappe aux objections qui en font une version inadéquate du physicalisme. Pour ce faire, j’identifie les trois raisons qui motivent le physicalisme, c’est-à-dire la parcimonie, le naturalisme et l’argument de la clôture causale, et j’argumente qu’il faut considérer que le monisme russellien satisfait ces trois motivations. Empirical research has distinguished moral judgments that focus on an act and the actor’s intention or mental states, and those that focus on results of an action and then seek a causal actor. Studies indicate these two types of judgments may result from a “dual-process system” of moral judgment (Cushman 2008, Kneer and Machery 2019). Results-oriented judgements may be subject to the problem of resultant moral luck because different results can arise from the same action and intention. While some argue (...) luck should not bear on persons’ culpability, Victor Kumar has argued that the tendency to hold unlucky agents responsible for harm is justified by consequentialist aims of punishment (Kumar 2019). In contrast, judgments that focus on acts and intentions may be primarily retributive. Kumar claims that judgments focused on results track external, public harm because this increases the reliability of punishment and better achieves instrumental aims, including deterrent effect. In this chapter I examine rape cases using Kumar’s theory of punishment. Rape involves outcomes that are not publicly available. If judgments of punishment depend on outcomes, then we would expect such judgments to be less stable for those instances of wrongdoing that lack public outcomes such as rape, because such judgments would rely instead on often biased and unreliable inferential processes to establish the presence of mental states, which are essentially private. In this way Kumar’s theory actually predicts the way in which we see criminal justice institutions fail with regard to arrest, prosecution, and punishment related to rape; and we might expect similar failures for other crimes that lack publicly available results. In sum, a fundamental problem with institutionalized punishment centered upon results may be that some crimes sit within a moral blindspot. (shrink)

B a c k g r o u n d . The article is devoted to the Minnemystik of Hadewijch of Brabant in the XIII century. It deals with the genesis of Hadewijch's concept of Minne in its relation to the monastic Cistercian mysticism of Bernard of Clairvaux, William of Saint-Thierry in the XII century and Beatrice of Nazareth in the XIII century. It also considers the conception of theologist and philosopher Richard of Saint-Victor in the XII century. Considering (...) the existing advances of researchers on Hadewijch's Minnemystik, since the XX century, this investigation especially focuses on the primary role of the secular tradition of minnesingers and trobairitz of the mid-XIII century in her texts. M e t h o d s . The main method of the article is a comparative analysis. It is used to find the common meaning of Minne in two traditions: secular and religious minnesingers. The historical-philosophical approach allows us to demonstrate the conceptual link between monastic theology in the XII–XIII centuries and Hadewijch's beguinal Minnemystik. R e s u l t s . The article sheds light on Hadewijch's concept of the Minne and stresses the primary role of the secular and religious conceptions of predecessors and contemporaries in Hadewijch's Minnemystik. C o n c l u s i o n . The author underlines that Hadewijch's concept of Minne comes from the secular tradition of minnesingers and, especially, trobairitz. It also derives from the XII-century male and female mystic theology, which follows Augustine. Thus, the concept of the Minne is deeply connected with the notion of Amor and the tradition of "courtly love", and with Caritas and the tradition of "pure love". Arguments attempting to debunk moral beliefs, by showing they are unjustified, have tended to be global, targeting all moral beliefs or a large set of them. Popular debunking arguments point to various factors purportedly influencing moral beliefs, from evolutionary pressures, to automatic and emotionally-driven processes, to framing effects. We show that these sweeping arguments face a debunker’s dilemma: either the relevant factor is not a main basis for belief or it does not render the relevant beliefs unjustified. Empirical debunking arguments (...) in ethics can avoid this predicament, but only if they are refocused on highly selective classes of moral belief. Experimental data can combine with familiar consistency reasoning to reveal that like cases are not being treated alike. Selective debunking arguments are unlikely to yield sweeping sceptical conclusions, but they can lead to rational moral change. (shrink)

Can reasoning improve moral judgments and lead to moral progress? Pessimistic answers to this question are often based on caricatures of reasoning, weak scientific evidence, and flawed interpretations of solid evidence. In support of optimism, we discuss three forms of moral reasoning (principle reasoning, consistency reasoning, and social proof) that can spur progressive changes in attitudes and behavior on a variety of issues, such as charitable giving, gay rights, and meat consumption. We conclude that moral reasoning, particularly when embedded in (...) social networks with mutual trust and respect, is integral to moral progress. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

The concept of artificial intelligence is not new nor is the notion that it should be granted legal protections given its influence on human activity. What is new, on a relative scale, is the notion that artificial intelligence can possess citizenship—a concept reserved only for humans, as it presupposes the idea of possessing civil duties and protections. Where there are several decades’ worth of writing on the concept of the legal status of computational artificial artefacts in the USA and elsewhere, (...) it is surprising that law makers internationally have come to a standstill to protect our silicon brainchildren. In this essay, it will be assumed that future artificial entities, such as Sophia the Robot, will be granted citizenship on an international scale. With this assumption, an analysis of rights will be made with respect to the needs of a non-biological intelligence possessing legal and civic duties akin to those possessed by humanity today. This essay does not present a full set of rights for artificial intelligence—instead, it aims to provide international jurisprudence evidence aliunde ab extra de lege lata for any future measures made to protect non-biological intelligence. This article analyzes the view of evolutionary theory as a theory of forces. The analogy with Newtonian mechanics has been challenged due to the alleged mismatch between drift and the other evolutionary forces. Since genetic drift has no direction several authors tried to protect its status as a force: denying its lack of directionality, extending the notion of force and looking for a force in physics which also lacks of direction. I analyse these approaches, and although this strategy finally succeeds, (...) this discussion overlooks the crucial point on the debate between causalists and statisticalists: the causal status of evolutionary theory. There has been a long history of tension between feminists and feminist philosophy, on the one hand, and logic, on the other hand. This tension expresses itself in many ways, including claims that logic is a tool of the patriarchy, that logic/rationality/analytical tools in philosophy need to be rejected if women are to fully participate, that women = body and man = mind, that to do feminist philosophy one must do it as a situated, embodied person, not as an impersonal, (...) disembodied mind, that logic is “a masculine subject”. However the tension is expressed, it is women in logic and women logicians who are caught in between. The goal of my paper is to explore a conception of logic that not only is not inconsistent with being a feminist, but is actively welcoming of women as logicians. (shrink)

Adequate epistemic justification is best conceived as the appearance, over time, of knowledge to the subject. ‘Appearance’ is intended literally, not as a synonym for belief. It is argued through consideration of examples that this account gets the extension of ‘adequately justified belief’ at least roughly correct. A more theoretical reason is then offered to regard justification as the appearance of knowledge: If we have a knowledge norm for assertion, we do our best to comply with this norm when we (...) express as assertions only beliefs that appear to us to be knowledge. If we are doing our best, there is little point in further sanctions. So a norm of knowledge for assertion would lead to a secondary norm of justified belief as the appearance of knowledge, marking a point at which our assertions may be corrected but should not be blamed. Of the various loci of systematic theology that call for sustained philosophical investigation, the doctrine of sanctification stands out as a prime candidate. In response to that call, William Alston developed three models of the sanctifying work of the Holy Spirit: the fiat model, the interpersonal model, and the sharing model. In response to Alston’s argument for the sharing model, this paper offers grounds for a reconsideration of the interpersonal model. At a 2011 meeting of the Society of Christian Philosophers, N. T. Wright offered four reasons for rejecting the existence of soul. This was surprising, as many Christian philosophers had previously taken Wright's defense of a disembodied intermediate state as a defense of a substance dualist view of the soul. In this paper, I offer responses to each of Wright's objections, demonstrating that Wright's arguments fail to undermine substance dualism. In so doing, I expose how popular arguments against dualism fail, (...) such as dualism is merely an unwarranted influence of Greek culture on Christianity, and substance dualism is merely a soul-of-the-gaps hypothesis. Moreover, I demonstrate that Wright himself has offered a powerful reason for adopting substance dualism in his previous works. In conclusion I offer a view that explains why the human soul needs a resurrected body. (shrink)

Overview of challenges facing philosophical analyses of experience in the face of life with constant connection, social media, and data mining.

The psychological literature now differentiates between two types of psychopath:successful (with little or no criminal record) and unsuccessful (with a criminal record). Recent research indicates that earlier findings of reduced autonomic activity, reduced prefrontal grey matter, and compromised executive activity may only be true of unsuccessful psychopaths. In contrast, successful psychopaths actually show autonomic and executive function that exceeds that of normals, while having no difference in prefrontal volume from normals. We argue that many successful psychopaths are legally responsible for (...) their actions, as they have the executive capacity to choose not to harm (and thus are legally rational). However, many unsuccessful psychopaths have a lack of executive function that should at least partially excuse them from criminal culpability. Although a successful psychopath's increased executive function may occur in conflict with, rather than in consonance with their increased autonomic activity - producing a cognitive style characterized by self deception and articulate-sounding, but unsound reasoning - they may be capable of recognizing and correcting their lack of autonomic data, and thus can be held responsible. To emphasize what we have outlined in a preceding paper, we consider the following: that human consciousness model should take into consideration “spirit” role, i.e. the mind-body-spirit as integral aspect, which view is neglected in the so-called Freudian mental model. This addendum expands upon the arguments made in the author’s 2020 essay, “Legal Personhood for Artificial Intelligence: Citizenship as the Exception to the Rule”, in an effort to display the significance human augmentation technologies will have on (feasibly) inadvertently providing legal protections to artificial intelligence systems (AIS)—a topic only briefly addressed in that work. In this paper I aim to show that the philosophy of Mihai Şora can both be seen as a phenomenological treatment of being and as a general theory of being in its most rigorous sense. At least, this philosophy could be designated as a phenomenological ontology which opens up itself towards an originally metaphysical perspective based on a specific type of knowledge of the sort of “global disclosure”. I will argue too that within Şora's philosophy one can have a twofold (...) approach: one starts from what we could call the phenomenology of the “common givenness” (“ordinary/ quotidian givenness”) and then proceeds (in a phenomenological manner) to a general theory of being, which is represented in Şora's philosophy by the constitution of the model of the “sphere with the null ray”; the second commences with the treatment of the ontological model as such (the model, which is already formed, represents in the end the symbolic structure of reality), that is, from this “general theory of being” (or of the constitution of being) and then advances step by step towards various (phenomenological) applications of this ontological model to the multifaceted spheres of the domain of being (the sphere of language, of temporality, of ethics, of the social, of politics, etc.). This article is an update of our previous article in this SGJ journal, titled: On Gödel's Incompleteness Theorem, Artificial Intelligence & Human Mind. We provide some commentary on the latest developments around AI, humanoid robotics, and future scenario. Basically, we argue that a more thoughtful approach to the future is "techno-realism.".

Spiritual formation currently lacks a robust epistemology. Christian theology and philosophy often spend more time devoted to an epistemology of propositions rather than an epistemology of knowing persons. This paper is an attempt to move toward a more robust account of knowing persons in general and God in particular. After working through various aspects of the nature of this type of knowledge this theory is applied to specific issues germane to spiritual formation, such as the justification of understanding spiritual growth (...) on an integrative and holistic (heart and mind) model, the reality of hearing God’s voice, and knowing his activity, as well as how such a theory should change the shape of sermons, evangelism, and apologetics. The rapid advancement of artificial (computer) intelligence systems (CIS) has generated a means whereby assistive bionic prosthetics can become both more effective and practical for the patients who rely upon the use of such machines in their daily lives. However, de lege lata remains relatively unspoken as to the legal status of patients whose devices contain self-learning CIS that can interface directly with the peripheral nervous system. As a means to reconcile for this lack of legal foresight, this article approaches (...) the topic of CIS-nervous system interaction and the impacts it may have on the legal definition of “persons” under the law. While other literature of this nature centres upon notions of transhumanism or self-enhancement, the approach herein approached is designed to focus solely upon the legal nature of independent CIS actions when operating alongside human subjects. To this end, it is hoped that further discussion on the topic can be garnered outside of transhumanist discourse to expedite legal consideration for how these emerging relationships ought to be received by law-generating bodies internationally. People tend to be repulsed by the idea of cash markets in kidneys, but support the trading of kidneys through paired exchanges or chains. We reject anti-commodification accounts of this reaction and offer an egalitarian one. We argue that the morally significant difference between cash markets and kidney chains is that the former allow the wealthy greater access to kidneys, while the latter do not. The only problem with kidney chains is that they do not go far enough in addressing (...) equality concerns, and we show how the introduction of cash payments by the state could remedy this. In the present paper we discuss: a) how Hilbert’s unification program failed completely, and b) we outline a new electron model based on Helmholtz’s electron vortex and Kolmogorov theory of turbulence. Novelty aspect: we discuss among other things, electron capture event, and von Karman vortex street. We also discuss a new model of origination of charge and matter. This paper is a sequel to a preceding paper on similar theme.

It is known that most existing cosmology models do not include rotation, with few exceptions such as rotating Bianchi and rotating Godel metrics. Therefore in this paper we aim to discuss four possible ways to model rotating universe, including Nurgaliev’s Ermakov-type equation. It is our hope that the new proposed method can be verified with observations, in order to open new possibilities of more realistic nonlinear cosmology models.

In RG forum, one senior professor of physics posted a project called: “Future science and technology.” As a response, one of us (VC) wrote in reply: “I think one of future science's tasks is to discover the link between entanglement and classical electromagnetic theory. This is to fulfill Einstein's position that present QM theory is incomplete, a new one must be found. We are on a way to that goal.” Therefore, in this paper we will discuss how entanglement can be (...) explained in terms of Maxwell-Dirac isomorphism. In a recent paper in Astrophysics and Space Science Vol. 364 no. 11 (2019), S. Ershkov & D. Leschenko presented a new solving procedure for Euler-Poisson equations for solving momentum equations of the CR3BP near libration points for uniformly rotating planets having inclined orbits in the solar system with respect to the orbit of the Earth. The system of equations of the CR3BP has been explored with regard to the existence of an analytic way of presentation of the approximated solution (...) in the vicinity of libration points. A new and elegant ansatz has been suggested in their publication whereby, in solving, the momentum equation is reduced to a system two coupled Riccati ODEs. In this paper, we presented a numerical solution of such coupled Riccati ODEs using Mathematica software package. (shrink)

The central objective of Dewey’s Democracy and Education is to explain ‘what is needed to live a meaningful life and how can education contribute?’ While most acquainted with Dewey’s educational philosophy know that ‘experience’ plays a central role, the role of ‘situations’ may be less familiar or understood. This essay explains why ‘situation’ is inseparable from ‘experience’ and deeply important to Democracy and Education’s educational methods and rationales. First, a prefatory section explores how experience is invoked and involved in pedagogical (...) practice, especially experience insofar as it is (a) experimental, (b) direct, and (c) social-moral in character. The second and main section on situations follows. After a brief introduction to Dewey’s special philosophical use of ‘situation’, I examine how situations are implicated in (a) student interest and motivation; (b) ‘aims’ and ‘criteria’ in problem-solving; and (c) moral education (habits, values, and judgements). What should become abundantly clear from these examinations is that there could be no such thing as meaningful education, as Dewey understood it, without educators’ conscious, intentional, and imaginative deployment of experience and situations. While we completely understood that a binary dwarf companion of the Sun has not been accepted by majority of astronomers, allow us to present some new arguments, along with our own serendipitous encounter with such a binary companion of the Sun. We hope that the present note will be found useful for further investigations, in relation to Planet Nine and such a dwarf star companion of the Sun (sometimes dubbed as Nemesis). El Naturalismo Trascendental del Ultimo Wittgenstein The present article considers an internal tension in Wittgenstein's late philosophy. In what I call his 'naturalism', Wittgenstein circumscribes philosophical reflection to natural objects, to «making natural history». In his 'transcendentalism' he focuses on the «possibility of phenomena» and distinguishes philosophical method from the method of the natural sciences. I show that his 'transcendentalism' is present in his discussion of rules and prívate language, arguing for an interpretation in terms of a kantian type of (...) transcendental synthesis. But far from contradicting his 'naturalism', both tendencies are inseparable and essential to the main purpose of his Philosophical Investigations. (shrink)
